Appointments:

                Patricia Caporale – Town Comptroller

                RESOLVED, that Patricia Caporale be and is hereby reappointed to the position of Town Comptroller and shall have all the powers and perform all of the duties of the Town Comptroller not inconsistent with the law, at the pleasure of the Town Board or until the first day of January next succeeding the first biennial Town Election at an annual salary of $92,750.00.

            Jeannette Koster – Town Attorney

RESOLVED, that Jeannette Koster be and is hereby reappointed to the position of Town Attorney and shall have all the powers and perform all of the duties of the Town Attorney not inconsistent with the law, at the pleasure of the Town Board or until the first day of January next succeeding the first biennial Town Election at an annual salary of $113,300.  

             Barbara Korsak – Receiver of Taxes

  RESOLVED, that Barbara A. Korsak be and is hereby appointed Receiver of Taxes and shall have all the powers and perform all of the duties of the Receiver of Taxes not inconsistent with the law, at the pleasure of the Town Board or until the first day of January next succeeding the first biennial Town Election at an annual salary of $78,280.00;

FURTHER RESOLVED, it shall not be a requirement of this appointment that the Receiver of Taxes reside in the Town of Yorktown.

9.         RESOLUTIONS

Request from the Assessor:

            Approve Certiorari Settlement

     WHEREAS, tax certiorari proceedings were instituted challenging the assessment for parcel known as Section 15.15, Block 1, Lot 31, located at 1969 East Main Street, Mohegan Lake, on the Tax Map of the Town of Yorktown, now therefore be it

     RESOLVED, that the tax certiorari proceedings affecting tax parcel 15.15-1-31, Account Number 0524500, owned by A G Scip Enterprise LLC ,  for assessment roll years 2007, 2008, 2009, 2010, 2011 and 2012 be settled as set forth in the proposed stipulation as follows:

Request from the Engineering Department:

           Performance and Erosion Control Bond Release:

           Mohegan Lake Motors

WHEREAS, Barry Rost as applicant, provided the Town with Selective Insurance Company of America Site Plan Bond #B1121079, in the amount of $247,684.00 to serve as the Performance Bond for the Mohegan Lake Motors Site Plan located on Route 6, and

WHEREAS, Barry Rost as applicant, provided the Town with Selective Insurance Company of America Permit Bond #B1121084, in the amount of $20,000.00 to serve as the Erosion Control Bond, and

WHEREAS, the applicant has requested his Performance & Erosion Control bonds be released as all site work is complete, and

WHEREAS, the Town Engineer has informed this Board that a representative of her department has inspected the property and determined all public improvements have met Town requirements, NOW, THEREFORE, BE IT

            RESOLVED, that the above referenced bonds be released to Barry Rost, Mohegan Lake Motors, 1791 East Main Street, Mohegan Lake, NY 10547.

 

            Richmond Community Center

            Whereas, the Richmond Community Center has applied for a Town Board Wetland permit and

            Whereas, the Town Board determined on October 8, 2013 that the changes to the plan are minor to extent that a public hearing is waived

            Whereas, the Town’s Wetland Consultant and Engineering department has review the amended application now therefore be it

            Resolved, that the Town Board authorize the revisions to the existing permit now be handled via an administrative permit.

 

Request from the Highway Superintendent:

            Release Escrow Deposit – Street Opening Permit

            RESOLVED, that the escrow deposit for Street Opening Permit #012-010 in the amount of $1,000.00 be released.

                        RESOLVED, that Sani-Pro Service Corp. dba Suburban Carting Co. be and is hereby granted renewal of their garbage license for commercial properties only, for the year 2014.

                   Public Hearing:

            Permit for a Convalescent Home at 482 Underhill Avenue

            NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board, Town of Yorktown, Westchester County, New York at the Town Hall, 363 Underhill Avenue, Yorktown Heights, 10598 on the 18th day of February, 2014 at 7:30 PM or as soon thereafter as the same can be heard, to consider the application received from Tom McCrossan and Mark McGoldrick  for a Special Use Permit to operate a Convalescent Home at 482 Underhill Avenue, Yorktown Heights, NY 10598.

 

            Bids:

            RESOLVED, that the Coordinator of the Refuse and Recycling Department is hereby granted permission to re-advertise specifications for Body Work on Town Cars.

            RESOLVED, that the Coordinator of the Refuse and Recycling Department is hereby granted permission to re-advertise specifications for Body Work on Town Trucks.

Sherry Drive Sewer Relining

            Whereas, invitation to bid for the Sherry Drive Storm Sewer Relining for the Town of Yorktown was duly advertised, and

            Whereas, said bids were received and opened on January 7, 2014, with the bid amounts for the above-referenced project summarized are as follows:

            Resolved, that upon the recommendation of the Highway Superintendent Dave Paganelli, the bid for the Sherry Drive Storm Sewer Relining be and is hereby awarded to Green Mountain Pipeline Services, 244 Waterman Road, Royalton, VT 05068.

 

12.          ORGANIZATIONAL RESOLUTIONS:

          

SALARIES

RESOLUTION

            RESOLVED, that the Supervisor be hereby authorized and directed to pay salaries of all elected and appointed Town officials and employees without prior audit.

          

MILEAGE RATE

RESOLUTION #       

          RESOLVED, that the rate of 55.5 cents per mile be allowed to those Town officials and employees who use their own automobiles in the performance of their official duties in accordance with the budgetary appropriations, provided however, the expense incurred is presented to the Town Board in the proper manner and on the proper claim form.

          

BLANKET AUTHORITY/SIGN CONTRACTS

RESOLUTION #       

            RESOLVED, that the Town Board hereby grants blanket authority to sign contracts for the Town, without the necessity of express advance approval by the Town Board to the Supervisor in the event the contract involves any expenditure of not more than $12,500, not to exceed $50,000 in any calendar year and is limited to one year in duration and be it

 

            FURTHER RESOLVED, that this blanket authorization shall remain in effect until amended.

 

FISCAL REPORT FILING TO STATE COMPTROLLER

RESOLUTION #

            RESOLVED, that by the authority vested pursuant to Paragraph 10-a of Section 29 of the Town Law, the Supervisor shall submit to the Town Clerk within one hundred twenty days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller.

                      

COMPTROLLER TO REFUND

CERTAIN CORRECTIONS OF ERROR

RESOLUTION #                   

            RESOLVED, that the Comptroller is appointed, as per Section 554 of the Real Property Tax Law to make refunds for correction of error up to a maximum of $2,500.00.

          

NEW YORK STATE DIVISION OF YOUTH STATE AID

RECREATION/YOUTH SERVICES PROJECT

RESOLUTION #       

            RESOLVED, that the Supervisor be directed to make application to the New York State Division of Youth for State Aid for a Recreation and Youth Service Project Grant for 2014. The Parks and Recreation Department receives $10,000 of this application for youth recreation, and the Police Department receives another $10,000 for the Youth Officer.
